City Responds to Norfolk Southern Claims Regarding Hauling Permits, Control of Facility

On July 16, the City Attorney responded to letters sent to the Department of Transportation and Environmental Services on behalf of Norfolk Southern and RSI Leasing, Inc., regarding the City’s hauling permit to RSI Leasing. RSI Leasing is the contractor that conducts the transloading operations at the Norfolk Southern facility. 

The Norfolk Southern/RSI letters maintain that RSI Leasing has no control over the ethanol transloading facility, and consequently, should not have been issued the permit.  The City's response, which cites the contract between RSI and Norfolk Southern, asserts that RSI is operating the facility and is the correct party to be subjected to the permit.
