As advised by our legal counsel, the only individuals who have been subpoenaed in this matter are: (1) individuals who were identified by the plaintiffs, under oath, as potential third-party witnesses; and (2) individuals who appear to have been involved with the litigation based on emails that have been produced in discovery.  Like any other litigant, the City is entitled to seek discovery, including discovery from non-parties. Any objections to the subpoenas should be handled in the ordinary course, which involves meetings between the City’s attorneys and the attorneys for the subpoena recipients.  

The City will have no further comment on this or any other ongoing litigation.
